Maintenance pending suit

M v M [2009] Family Law 8

The wife’s petition for divorce resulted in lengthy proceedings concerning the jurisdiction of the English courts, during which the husband was ordered to pay £10,000 per month maintenance pending suit (MPS). He paid nothing. Arrears of £200,000 had accumulated when the wife withdrew her petition and consented to its dismissal. Was the husband still bound to pay the arrears under the order?
