Ancillary relief appeal

Judge v Judge [2008] EWCA Civ 1458 19 December

The wife failed in an application to set aside ancillary relief orders and the husband sought his costs. The wife argued that her application was an application for ancillary relief and therefore under FPR 2.71(4)(a) general rule was that the court would not make an order requiring one party to pay the costs of another party in ancillary relief proceedings.
