Partial success
Alan Williams Entertainment Ltd v Hurd CA (Civ) SJ 10 November
The claimant claimed damages for breach of a compromised agreement and the defendant counterclaimed damages arising out of
the same agreement. Each side was partially successful and the judge ordered the defendant to pay 75% of the claimant’s costs.
The defendant appealed contending that he had succeeded on more issues than the claimant and that in any event the judge should
not have made any order for costs until the quantum of damages had been decided.
