Vaughan v (1) Jones (2) Fowler [2006] EWHC 2123 (Ch)

The three parties were neighbours and there was a history of antagonism between them. The second defendant lent the first defendant money to fund litigation between her and the claimant. In return, the second defendant obtained an option to purchase the first defendant’s property. The first defendant lost the litigation, sold her property to the second defendant and went bankrupt. The claimant sought costs from the second defendant.
