Nayler v Beard (CA [2001] EWCA Civ 1201)
In a partnership dispute the claimant sought from the defendant disclosure of certain affidavits of means he had filed in
connection with his ongoing ancillary relief proceedings. The claimant maintained that documentation was required in order
to ensure a fair trial of the issues in the civil proceedings and that the affidavits were likely to demonstrate that the
defendant had given conflicting evidence in the two sets of proceedings.
