Banque Paribas v. The Fund comprising proceeds of sale of the M.V. Emerald Transporter - 1985(2) S.A. 452

Associated ship - Priority of claims against fund in Court

The vessel Emerald Transporter was owned by Outer Ocean Navigation Corpn. Ltd. which owned other vessels which were “associated ships” in terms of section 3(7)(a)(i) of the Admiralty Jurisdiction Regulation Act, 105 of 1983. The Emerald Transporter was arrested and sold pursuant to a court order. Disputes arose as to the priority of claims on the fund in court.
