Principles to be applied in granting Mareva injunctions

By an agreement under the Norwegian Sale Form dated 24 January 1983 the defendants agreed to sell the vessel Niedersachsen to the plaintiffs. Clause 18 provided the vessel was to be delivered “present class fully maintained, free of recommendations, free of average damage affecting class”.
