Ricargo Trading v. Spliethoff’s Bevrachtingskantor B.V. (The Tassos N) - Q.B.D. (Com.Ct.) (Lloyd J.) - 3 March 1983

Whether vessel on demurrage during transit to diverted discharge port

Under a charterparty on the Gencon form the Tassos N was to carry a cargo of timber from Finland to Aqaba. When she arrived at the discharge port delay occurred because of congestion. Laytime had expired before the vessel was able to discharge. The charterers and owners subsequently agreed that the vessel would be diverted to a Turkish port. The vessel sailed from Aqaba to discharge at Mersin - a voyage of some 6 days.
