General average - Cargo on barge in tow of tug

The plaintiffs were the owner and operator of the barge Lakelse on which the defendant’s cargo was being carried up the west coast of Canada in tow of a tug chartered for the voyage. The contract of carriage between the plaintiffs and the defendant was evidenced by a bill of lading which provided for general average to be adjusted according to York-Antwerp Rules and for the payment of special charges on cargo.
