Merkur Island Shipping Corporation v. Laughton (The Hoegh Apapa) - Court of Appeal (Sir John Donaldson M.R., O’Connor & Dillon L.JJ.) - 4 November 1982

ITF’s blacking not protected under 1980 Employment Act

This was another case involving action taken by the ITF to encourage a shipowner to agree terms and wages acceptable to the ITF. The vessel Hoegh Apapa , on time charter, was ready to sail from Liverpool but the tugmen (who had a contract with the time charterers) refused to take the ship out. The issues were in fact identical to The Antama (see LMLN 57 - 7 January 1982).
