Amin Rasheed Shipping Corpn. v. Kuwait Insurance Co. (The Al Wahab) - Q.B.D. (Com. Ct.) (Bingham J.) - 30 March 1982

Kuwaiti marine insurance policy in Lloyd’s standard form - Proper law

The plaintiffs (Rasheed) were a Liberian corporation and owned the vessel Al Wahab . The defendants (KIC) were an insurance company incorporated in Kuwait and carrying on business there. Rasheed claimed against KIC in respect of the constructive total loss of the Al Wahab under a marine and war risks insurance policy issued by KIC in April 1979. The text of the policy very closely followed the language of the Lloyd’s S.G. policy but there were some differences. Under the KIC policy, the claim was to be paid in Kuwait and Kuwait was stated to be the place of issue. References to Lombard Street and London had been omitted.
