Cosmar Compania Naviera v. Total Transport Corpn. (The Isabelle) - Q.B.D. (Com. Ct.) (Robert Goff J.) - 23 February 1982

Laytime provisions and loading expenses under SHELLVOY 3 form

Cosmar chartered their vessel Isabelle to Total on the SHELLVOY 3 form for a voyage from one safe port Algeria to one or two safe ports in United States ranges. The Isabelle proceeded to Bejaia, the loading port, and anchored in the roads on 19 December 1980. Notice of readiness was received by the cargo suppliers on the morning of 20 December. Because of congestion in the port, aggravated by interruptions in loading caused by the “Ressac” (a heavy swell), the Isabelle had to remain in Bejaia roads until 1 January 1981. She made fast at the loading berth at 10 45 on that day and commenced loading.
