The plaintiff was the carrier of three containers of goods from China to Canada. Bills of lading were delivered to the shipper,
indicating that the goods were consigned ‘to order’, that the ‘Notify Party’ was the defendant Geo International (‘Geo’),
and that the place of delivery was Toronto. The goods reached Canada in early November 1997.
