Belship Navigation Inc v Sealift Inc (The ‘Huntsville’) -Before Jack Berg, Richard A Zimmerman and Henry E Engelbrecht (Chair) - 26 February 1998

Vessel time-chartered under illegal contract - Whether time-chartered owners entitled to restitution damages to compensate for partial performance of the charter

The registered owners of the vessel Huntsville were Huntsville Navigation Headowning Co Ltd of Malta. They chartered the vessel to Seabon Holding Corporation of Panama (‘the disponent owners’. The disponent owners in turn time-chartered the vessel to Belship Navigation Inc of Monrovia. Belship in turn time-chartered the vessel under the NYPE form to Sealift Inc to perform one lighterage voyage of about 30 days duration with 15,000 MT of bulk wheat from Assab anchorage to Massawa, Ethiopia.
